Welcome to Joi Digital Marketing! These Terms of Service (“Terms”) govern your use of our website, joidigitalmarketing.com, digital products, and services.

🔹 If you are purchasing branding, web design, or consulting services, a separate service contract will be signed that outlines additional specific terms beyond these general Terms of Service.

By accessing or using our website, services, or digital products, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Services Offered

Joi Digital Marketing provides:

Branding Services (logo design, brand strategy, brand identity)
Web Design Services (custom websites, UI/UX)
Consulting Services (business & marketing strategy)
Digital Products (branding templates, design assets, downloadable resources)

Age Requirement

You must be 18 years or older to use our services or purchase from our website. If under 18, parental consent is required.

3. Account Registration & Access

✅ You do not need an account to browse the website.
✅ An account is required to comment on blog posts.
✅ In the future, an account will be required to shop in our store.

🚨 Users are responsible for keeping their login credentials secure. We are not liable for unauthorized account access due to negligence.

4. Payments & Refund Policy

We accept Stripe (credit/debit card payments).

🔹 For Digital Products

All sales are final (non-refundable).
Digital products cannot be returned or resold.
Each user must purchase a separate license to use our digital products.

🔹 For Branding, Web Design, and Consulting Services

A 50% deposit is required upfront.
The remaining 50% is due before final delivery.
Refunds are reviewed case by case and granted at our discretion.
If a payment fails, we will contact you to retry.

🔹 Late Payments & Fees

Payments are due within 5 days of the invoice date.
After 5 days, a $50 late fee applies.
After 30 days, a 1% monthly interest fee is charged on unpaid balances.

5. Ownership & Intellectual Property

All content, digital products, and services offered by Joi Digital Marketing are protected under copyright law.

🚫 You MAY NOT:

Resell, redistribute, or modify our digital products.
Share purchased files with others (each user must buy a separate license).
Copy, reproduce, or use any of our content without permission.

✅ You MAY:

Share links to our products via social media.

Custom Branding & Web Design Work

After full payment, clients own the final designs, but Joi Digital Marketing retains authorship rights.
We reserve the right to showcase work in our portfolio unless otherwise agreed upon in writing.

6. Prohibited Activities

🚫 You must NOT use our website or services for:

Spamming, hacking, or disrupting our website.
Illegal activities, fraud, or misrepresentation.
Reselling our services without permission.
Copying, redistributing, or repurposing our content.

We reserve the right to terminate access or refuse service to anyone violating these Terms.

7. No Guarantee of Results

Joi Digital Marketing provides marketing, branding, and web design services, but we do not guarantee specific results from our strategies, as success depends on multiple external factors.

8. Dispute Resolution & Governing Law

We aim to resolve disputes amicably first. If a resolution cannot be reached, disputes must be settled through binding arbitration before any legal action is taken.

Governing Law: These Terms are governed by the laws of the State of Texas, USA.
Arbitration will be held in Texas, and both parties waive their rights to a jury trial.

9. Policy Updates & Acceptance

We reserve the right to update these Terms at any time. Changes will be announced on our website, and continued use of our services constitutes acceptance of the updated Terms.
